Legal validity of Guarantees Issued by the Fund<\/strong><\/p>\n\n\n\n

Within the national innovation ecosystem, Research and Technology Funds are non-governmental institutions established alongside Science and Technology Parks, innovation centers, universities, and other research institutions to promote private-sector participation and investment and to finance research, scientific, and technological activities, as well as startups, creative enterprises, and knowledge-based companies.<\/p>\n\n\n\n

Knowledge-Based Production Leap Law (Enacted in 2022)<\/strong><\/h2>\n\n\n\n

Under Article 4 of the Knowledge-Based Production Leap Law (2022), in addition to supporting knowledge-based companies and institutions and promoting the knowledge-based economy, Research and Technology Funds were added to Clause (h) of the Customs Affairs Law immediately after the term \u201cbank guarantees.\u201d\n\nFurthermore, under Clause (b) of the same Article, executive agencies, banks, non-bank credit institutions, and companies and entities affiliated with public non-governmental institutions, revolutionary bodies, and the Armed Forces of the Islamic Republic of Iran are authorized to accept, as valid guarantees, those issued by the Innovation and Prosperity Fund and by non-governmental Research and Technology Funds subject to Article 44 of the Law on Removing Barriers to Competitive Production and Enhancing the Financial System of the Country (enacted May 1, 2015), in relation to:\nCredit guarantees\n\nTender and procurement processes\n\nPurchase of goods and machinery\n\nContracting and project agreements\n\nPerformance obligations\n\nAdvance payments\n\nPerformance bonds<\/p>\n\n\n\n

This Executive By-Law, comprising nine (9) articles, sets out the framework for the establishment and formation of Research and Technology Funds and for the creation of the Secretariat of the Working Group of Research and Technology Funds as one of the pillars of the national innovation ecosystem.<\/p><\/div><\/div>

\t\t\t\n\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t<\/span>\n\t\t\t By-Law on Securing Government Transactions<\/strong><\/span><\/div>

Under this directive, guarantees issued by the Innovation and Prosperity Fund and non-governmental Research and Technology Funds\u2014pursuant to Article 100 of the Third Economic, Social and Cultural Development Plan (2000\u20132004), Article 45 of the Fourth Development Plan (2005\u20132009), and Article 44 of the Law on Removing Barriers to Competitive Production and Enhancing the Financial System of the Country (enacted May 1, 2015)\u2014have been approved and promulgated upon the proposal of the Management and Planning Organization of the Country and the confirmation of:\n\nThe Head of the Management and Planning Organization\n\nThe Governor of the Central Bank of the Islamic Republic of Iran\n\nThe Vice President for Science and Technology<\/p><\/div><\/div>

\t\t\t\n\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t<\/span>\n\t\t\t\u0622\u06cc\u06cc\u0646 \u0646\u0627\u0645\u0647 \u0627\u062c\u0631\u0627\u06cc\u06cc \u0645\u0627\u062f\u0647(100) Executive By-Law of Article 100 of the Third Economic, Social and Cultural Development Plan of the IRI<\/strong><\/span><\/div>

Article 7 of this By-Law defines the scope of activities of the Funds as follows:\n\nGranting loans and credit facilities\n\nProvision of venture capital and participation\/investment in research and technology projects\n\nGuaranteeing the timely payment of obligations and installments of research and technology projects at the contractual milestones, against receipt of a specified percentage of the total contract value and collection of project receivables from the employer, including delay penalties, in order to prevent disruption in project implementation\n\nIssuance of required guarantees for non-governmental research and technology institutions for the execution of research and technology projects, subject to obtaining adequate collateral from the applicant<\/p><\/div><\/div>

\t\t\t\n\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t<\/span>\n\t\t\tLaw on Supporting Knowledge-Based Companies and Institutions and Commercialization of Innovations and Inventions<\/strong><\/span><\/div>

This Law provides for the establishment of the Innovation and Prosperity Fund to facilitate the commercialization of innovations and inventions and to promote the practical application of technical knowledge through the provision of qard-al-hasan (interest-free) facilities.\n\nIt also authorizes the Government to participate in the establishment of non-governmental Research and Technology Funds in order to encourage private-sector participation and investment and to provide both quantitative and qualitative support for research and technology activities, particularly applied and developmental research.<\/p><\/div><\/div>

\t\t\t\n\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t<\/span>\n\t\t\tFourth Economic, Social and Cultural Development Plan<\/strong><\/span><\/div>

Under Article 45 of the Fourth Development Plan, the Government is mandated to take measures to expand the market for knowledge-based products, commercialize research achievements and innovation, and strengthen the role of the private and cooperative sectors in this field.\n\nOne of the measures expressly provided in this Article is support for the establishment and development of non-governmental Research and Technology Funds.<\/p><\/div><\/div><\/div><\/div><\/div>","protected":false},"excerpt":{"rendered":"
